 SB 1171 SD1 HD2 – REVIEW OF HISTORIC PRESERVATION PROJECTS.

Authorizes the phased review of certain projects by the Department of Land and Natural Resources’ State Historic Preservation Division to ensure consistency between state and federal law. Removes language that provided the Governor with the option to request the Hawaii Advisory Council on Historic Preservation to report in cases where an agency, officer, or other person is dissatisfied with a decision of the Hawaii Historic Places Review Board. I’m usually so busy working on our subject bills during the session that I don’t have time to work on other important bills. All session, in my peripheral vision, was this bill that called for phasing reviews of certain development projects.  Phasing is a violation of the 40 year old environmental review process that mandates a review of all social, cultural, environmental and economic impacts of a proposed project that is on state land or uses state money. The most recent review of this law was in the rail project where the developer didn’t do a complete review, was sued, and lost in court.

The phasing of the rail project has caused many delays as they have found `iwi kupuna all over the proposed project corridor.

This morning, I went to the conference committee on this bill where the Senate adopted the House Draft 2 of the bill. This vote would change the decades-old law in defiance of the court and threatens all that is sacred and special about Hawai`i nei . Now the bill will go to the floor of the Senate for a final vote and passage.

This bill is very controversial and I am respectfully asking that  you contact the following Senators to ask them to vote NO on this bad bill.
