RELATING TO HAWAIIAN AFFAIRS.

Prohibits the transfer of inmates in the custody of the department of public safety to any correctional facility that is not operated by and within the State. Removes mandatory minimum sentencing for methamphetamine drug offenses. ING, BROWER, EVANS, SAIKI

CAP POSITION: SUPPORT

This bill does 3 things

1)     bans the transfer of individuals incarcerated by Hawai`i to any private correctional facilities

2)     Repeals mandatory sentencing for methamphetamine (last session we got the mandatory sentences reduced for A (from 20 to “not less than 10 yrs” & B to “Not less than 5 years”)

3)     The language in Section 3 is confusing, so CAP is focusing on and supporting  sections 1) and 2).
