CAPWatch Conference Update 4.28.15

GREAT NEWS!

CAPWATCHTwo of our bills passed out of conference today (Tuesday, 4.28): SB 211 re DNA testing and SB 569, which raised the felony theft threshold to $750 (it has been at $300 sine 1986). This was part of the 2012 JRI bill. CAP has been working to raise the threshold since 2005! I’m also happy to report that most of our bills have opened in conference. 8 of the bills we have been working on have been in conference yesterday and today. Here’s what happened:

Monday: The House prepared the CD1 that allows for vertical integration, but does not mandate it; the # of dispensaries is phased in with separate  licenses for  dispensaries and production centers; 2 on Hawai`i Island; 2 on O`ahu; 1 on Maui and 1 on Kaua`i; allows for missed integration to allow for crop failure; the House adopted the Senate timeline – 10/15 DOH completes Interim rules in effect until 7.1.18; and RFP is open from 12/15 – 1/16; 3.1.16 first licenses are offered; Dispensary application available 7.1.16;1 dispensary per 500 patients by 1.1.18; sunrise clause for reciprocity; implements the phase-out of caregivers; home grow still allowed for patients. The committee agreed to reconvene at 2:45 pm. today.

2:45 pm: The committee will reconvene tomorrow, 4.28 at 8:15 am.

Tuesday: The Senate presented a draft that is radically different from the House’s CD1. Chair Green outlined the elements of the bill: reciprocity; 3 year phase out of caregivers; formulations for medical marijuana; SD1 language; no tax. The bill includes 15 pages of rules from DOH; third party to conduct the application process on hi.gov site that is secure, objective, and transparent; businesses must be 51% locally owned; can start in 1 year and applications ready on 7.31.15; lab testing to guarantee purity and asking DOH to standardize lab testing. The House responded that they had big problems with mandating vertical integration and first come/first served approach to selection. The committee will reconvene tomorrowWednesday, 4.29 at 3 pm in 229.

SB 737 SD1 HD1       LIMITING INTEREST ON PAYDAY LOANS

Conference opened today on this bill. Sen. Baker proposed a cap and a section asking the Commissioner of Financial Institutions to look into regulations for next session. She said that she spoke with the Commissioner of Financial Institutions and they are willing to do so. The Senate will draft the CD1 for the House to review. The House agreed that an annual % and the cap are interchangeable. The Chair said that chasm was about how to approach the issue. The committee will reconvene at 11am tomorrow, Wednesday,4.29, in 016.
